
Terms & Conditions
DEFINITIONS
1. ‘Authorised Ticket Seller’ means Us or a person authorised by Us to supply Tickets to an Event.
2. ‘Companion Card’ means a card issued under the NSW Companion Card program.
3. ‘Consumer Laws’ mean the Australian Consumer Law, as set out in Schedule 2 to the Competition and Consumer Act 2010 (Cth), and applicable State and Territory consumer protection legislation.
4. ‘Event’ means a theatre performance or other show arranged or presented by Us or on behalf of another organisation, for which We sell Tickets.
5. ‘Riverside Theatres’, mean City of Parramatta Council ABN 49 907 174 773, the holder of the ‘Riverside Theatre’ business name.
6. ‘Ticket’ means a revocable licence granted to a consumer to be admitted entry to an Event or to a Venue, subject to the Ticketing Terms and Conditions, evidenced by any ticket, voucher, coupon, card, badge, document, or other form of identification device, such as an electronic barcode, wristband, member’s card, or a credit card.
7. ‘Venue’ means Riverside Theatres, located at the Corner of Church and Market Streets, Parramatta NSW 2150 and all associated venues with Riverside Theatres.
8. ‘You’ and ‘Your’ mean the person accessing the Riverside Theatres website, the person seeking to purchase or acquire a Ticket, the person holding a Ticket, and/or the person seeking to attend an Event.
CONDITIONS OF SALE
9. The sale of a Ticket and attendance at an Event are subject to these Riverside Theatres website terms and conditions, the Live Performance Australia Ticketing Code of Practice – Industry Code and Consumer Code (‘LPA Code’), and any additional terms and conditions notified at the time of Ticket sale (collectively, ‘Ticketing Terms and Conditions‘).
10. Such Ticketing Terms and Conditions apply to both the original purchaser/Ticket holder and any subsequent Ticket holder, and You are deemed to have agreed to these Ticketing Terms and Conditions by acquiring a Ticket and/or seeking to attend an Event. By purchasing a Ticket on behalf of someone else, You undertake to inform them of these Ticketing Terms and Conditions.
11. Where the LPA Code and these Riverside Theatres website terms and conditions conflict, the Riverside Theatres website terms and conditions will prevail, to the extent of any inconsistency.
12. Riverside Theatres reserves the right to: add, withdraw, or substitute artists; vary advertised programmes; amend seating arrangements and audience capacity; and refuse admission, with reasonable cause. You will be notified of such changes where the LPA Code requires You to be so notified.
13. Except where prescribed laws provide otherwise, Tickets may not, without the prior written consent of Riverside Theatres, be re-sold or offered for re-sale for more than 110% of the original Ticket price. If a Ticket is sold or offered for re-sale or used in breach of this condition, the Ticket may be cancelled without a refund and the Ticket holder may be refused admission.
14. These Conditions of Sale also apply to Tickets issued by other Authorised Ticket Sellers (if any).
ADMISSION TO EVENTS
15. The right of admission to an Event is reserved by us.
16. You must hold a valid Ticket to attend an Event. We may refuse admission or remove any Ticket holder from the Venue (without a refund) in accordance with the LPA Code, including (but not limited to) where You:
a) cannot produce a valid Ticket for the Event;
b) produce a Ticket that has been handled or dealt with in a way that is contrary to these Ticketing Terms and Conditions, including a Ticket that is identified by Venue management staff as having been sold by an unauthorised seller, or the Ticket is an invalid or fake ticket;
c) cannot produce proof of your concession entitlement where a concession Ticket has been purchased;
d) have in your possession and/or refuse to surrender to Venue management staff any prohibited object or article including but not limited to dangerous items, photographic or recording equipment, or food or alcohol that is not permitted to be brought into or used in the Venue;
e) refuse to be subject to a visual search of your possessions, ;
f) behave in a manner which causes or may cause property damage or that threatens or may threaten the safety of performers, other consumers, or any other persons, including as a result of intoxication;
g) behave in a manner that unreasonably interferes with other consumers’ enjoyment of the Event, including through the use of cameras, mobile phones, personal computers, paging devices, or other electronic devices;
h) refuse to remain in the area or seat designated on your Ticket;
i) cannot produce proof of age;
j) refuse to comply with Venue safety requirements, which includes the Conditions of Entry & Patron Safety Policy; or
k) otherwise breach these Ticketing Terms and Conditions or fail to follow the reasonable directions of Venue management staff.
17. Children aged 0-18 months at the time of a performance may be seated on an adult’s lap free of charge. A valid ticket is required for all children over 18 months.
18. Recording of any Event by camera, tape recorder, or other recording technology is strictly prohibited.
19. Mobile phones, pagers, and other communications devices must be turned off and/or made silent before accessing the Event.
20. Latecomers will not be given access to the Event unless there is a suitable break in the program. Seating may be relocated because of late entry.
21. You enter the Venue at Your own risk and Riverside Theatres will not be responsible for any loss, damage, or injury due to a breach of these Ticketing Terms and Conditions.
CREATING AN ACCOUNT
22. Prior to purchasing a Ticket through the Riverside Theatres website, You may be asked to create a user account and to nominate an email address and password for Your account. You must maintain the confidentiality and security of Your user account (including your password) and not provide it to any other person.
23. You are responsible for Your use of the Riverside Theatres website and all transactions conducted using Your account. You must notify Riverside Theatres immediately if you become aware of any unauthorised use of Your account, to reset your password.
TICKET PRICES, DELIVERY, AND LIMITS
24. Ticket prices listed on the Riverside Theatres website are displayed in Australian dollars and include GST, if applicable. A tax invoice is available upon request to Riverside Theatres.
25. Ticket prices are subject to change without notice. Ticket prices may be categorised as ‘special offers’ for marketing promotions, which may increase or decrease prices at any given time, due to demand. In instances where special offers apply, You will not be entitled to a refund, credit, or an exchange if:
a) a special offer applies after You have purchased a Ticket at the original price;
b) You have purchased an original priced Ticket where a special offer is available, but were not aware of such offer; or
c) the price of any other Ticket for the Event (whether in the same price reserve or section) is reduced after Your original purchase.
26. A transaction fee may apply to Your Ticket purchase. You will be notified of all applicable fees prior to purchase. If we agree to exchange Your ticket, an exchange fee may apply.
27. Once confirmed, Your Ticket and any transaction fee will not be refunded or exchanged, except as provided for in these Ticketing Terms and Conditions or as required by law (including the Consumer Laws).
28. You acknowledge that You have the authority to make payment for your Ticket and that You own, have express permission of the owner of, or have the legal right to use, the credit card or other payment facility used to purchase the Ticket.
29. Incorrect Ticket pricing, regardless of whether the error arose due to an advertising error (online or otherwise communicated to You), human error, or a technical malfunction, may occur from time to time. If the amount You paid for Your Ticket is incorrect, Riverside Theatres may cancel the Ticket, refund to You the amount that You paid, and offer a replacement Ticket to You at the correct price.
30. Riverside Theatres will primarily use e-Tickets as the delivery method. You are responsible for either printing the e-Ticket or showing the e-Ticket on a suitable device. Riverside Theatres reserves the right to charge a servicing fee if you fail to do so, such that a replacement Ticket needs to be issued.
31. Delivery of Tickets will only be made upon receipt of full payment, and each valid e-Ticket will be sent to a purchaser’s email address 48 hours prior to the Event start time.
32. Where an e-Ticket is not applicable, Tickets will be set to venue collect, where it will be available for collection 48 hours prior to the Event start time.
33. If a duplicate copy of a Ticket appears, only the first copy to be scanned on arrival at the Event will allow the Ticket holder entry. Duplicate copies subsequently scanned will result in our system displaying the message ‘Already Scanned’ (or similar) and subject to verification, entry may be denied. Riverside Theatres reserves the right to request proof of identity and proof of purchase of the Ticket.
34. Unauthorised duplicate Ticket holders will be refused entry to the Venue.
35. Do not buy e-Tickets from unauthorised sellers. If an unauthorised seller has printed multiple copies of a single Ticket, You may be refused entry.
36. The sale of a Ticket is subject to availability.
REFUNDS AND EXCHANGES
37. Tickets cannot be refunded or exchanged after purchase except as provided for in these Ticketing Terms and Conditions or as required by law (including the Consumer Laws). In cases where an exchange or refund of Your Ticket is approved, We reserve the right to retain fees already charged and/or charge additional fees to You, as per 26 and 27.
38. The original purchaser of a Ticket is entitled to a refund if the relevant Event is cancelled or re-scheduled before the Event, or if the Event is significantly relocated, or if We are unable to provide You with the Event in question.
39. Any refund payable for a Ticket will be made to the original purchaser of that Ticket.
40. Refunds will not be issued for Tickets purchased from a re-seller or an unauthorised seller.
41. If You are not the original purchaser because You bought your Ticket from a re-seller, there is no guarantee that any refund provided to the original purchaser will be passed on to You.
42. We may cancel a Ticket if we reasonably consider that the Ticket was purchased fraudulently. Refunds will not be issued for Tickets which have been cancelled due to fraud or a breach of these Ticketing Terms and Conditions.
43. Unless required by law (including the Consumer Laws), We will not be liable for auxiliary expenses incurred by You in connection with your attendance or non-attendance at an Event, including if the Event is cancelled, rescheduled, or relocated.
44. Auxiliary expenses include, but are not limited to, the cost of travel, car-parking, child-care, and accommodation.
45. You should carefully consider the refund and cancellation policies of travel, accommodation, and other goods or service providers when making arrangements associated with attendance at an Event.
LOST OR STOLEN TICKETS
46. It is Your responsibility to keep your Ticket safe. Where a Ticket is lost, stolen, misplaced, or destroyed, Riverside Theatres may charge a servicing fee and require proof of identity and purchase, prior to issuing a replacement Ticket.
47. Riverside Theatres may not provide a replacement Ticket where:
a) Your Ticket is for general admission rather than allocated seating; or
b) Your request for a replacement Ticket has not been received by Riverside Theatres within a reasonable time prior to the Event.
COMPANION CARD SCHEME
48. Riverside Theatres is an affiliate of the NSW Companion Card program and admits carers to ticketed Events as ticketed complimentary guests (‘Companion’). The Companion must sit in the nearest available seat to the cardholder to assist them during their visit.
49. The use of a Companion Card is restricted to people who are unable to participate at a particular Venue or Event without attendant care and support.
50. Only the person whose photograph and name appear on the card can use the Companion Card.
51. A valid Companion Card or Companion Card number must be produced at the time of Ticket purchase, the point of Ticket collection, and/or on request, to gain access to the Companion Card Scheme offer.
52. The Companion’s Ticket is not valid unless the Companion Card holder is present at the Event to which the Ticket relates.
53. The Companion Ticket holder may be charged for the Ticket if the above requirements are not met.
54. Further details on the NSW Companion Card program are available on the Companion Card website.
GIFT E-VOUCHERS
55. Gift e-vouchers may be purchased from the Riverside Theatres website, and can be used to buy a Ticket for any Event, any day of the week (‘Gift E-Voucher’).
56. If Your purchase total exceeds the value of your Gift e-Voucher, you will have to pay the balance using another of Our accepted forms of payment.
57. Gift e-Vouchers are valid for a period of 3 years from the date of purchase. Any unused balance will not be refunded or credited on expiry.
58. If Your Gift e-Voucher is due to expire but has not been used, You may redeem it to buy a new Gift e-Voucher with a new 3-year validity period.
59. Gift e-Vouchers are non-refundable and cannot be redeemed for cash.
60. Riverside Theatres does not accept any liability for lost or stolen Gift e-Vouchers.
PROMOTIONS AND COMPETITIONS
61. If You received Your Ticket as a prize, gift, donation or otherwise at no cost, these Ticketing Terms and Conditions and the terms and conditions of the relevant promotion or competition apply to Your use of the Ticket.
PRAMS, STROLLERS AND WALKERS
62. Prams, strollers, and walkers will be restricted from entering the Venue’s theatres.
63. Alternative areas to park prams, strollers, and walkers will be provided on an event-by-event basis.
MERCHANDISE AND OTHER PRODUCTS
64. As a consumer, you are entitled to the benefit of statutory consumer guarantees in respect of items purchased at the Riverside Theatres Bar. In accordance with the Consumer Laws, if the item has a major failure, you may reject the item and seek a refund or exchange.
65. If the product we have provided to you is completely incorrect and not a close substitute, We will either:
a) provide You with a refund for the value of the originally ordered item; or
b) offer You a replacement item.
66. If We provide You an item with a packaging defect or other major defect, We will either:
a) Provide You with a refund for the value of the ordered item; or
b) offer You a replacement item.
USE OF THIS WEBSITE
67. These terms and conditions of use apply to use of this website. By using this website, You agree to accept and be bound by these terms and conditions of use.
68. You must:
a) ensure that Your access to and use of this website is not illegal or prohibited by any laws that apply to you;
b) not use this website in any manner that comprises or results in any illegal activities or the contravention of any relevant laws;
c) not use this website in any manner that comprises or results in the infringement of a third party’s rights or entitlement relating to privacy or intellectual property under any laws, standards, or codes relating to privacy or intellectual property;
d) not tamper with, hinder the operation of, or make unauthorised modifications to, this website.

73. All intellectual property rights (including, but not limited to, copyright) in the material which appears on this website (including, but not limited to, graphics, logos, icons, sound recordings, information content, and software) (‘Material’) is owned by or licensed to Riverside Theatres.
74. You are welcome to use and/or reproduce, for a personal or non-commercial purpose, only, the information content of the Material (excluding the graphics, logos, icons, sound recordings, and software), which appear on this website:
a) without the prior written approval of Riverside Theatres; and
b) unless otherwise specified, for no fee.
75. If You wish to:

80. At any time and without notice, Riverside Theatres may update, amend, or remove all or any part of this website (including, but not limited to, the Material on this website, the content of this website, and/or these terms and conditions of use).
ACCESS TERMINATION OR DENIAL
81. At any time and without notice, Riverside Theatres reserves the right to suspend, limit, deny, or terminate access to, or use of, all or part of this website and services available through this website, if there is an emergency or You engage in conduct that Riverside Theatres (in its absolute discretion) considers:
a) a contravention of these terms and conditions of use;
b) violates any rights or entitlements of Riverside Theatres or any third party;
c) to be inappropriate; or
d) to be an illegal activity.
EDUCATION BOOKINGS
82. Once booked, an invoice for the deposit amount of 25% will be automatically issued. Payment of the deposit is due within 10 working days to confirm the reservation. Cancellation of the booking can be made at any time during those 10 working days without penalty.
83. Once the deposit is paid, it is non-refundable and will be deducted from the total amount due.
84. Confirmation of final numbers and final balance is required 4 weeks prior to the performance date or we must have received the final purchase order from EdConnect.
85. If no balance of payment is received, Riverside Theatres reserves the right to cancel your booking and your deposit will be forfeited.
86. Once full balance is paid, it is non-refundable, and a reduction of numbers is not permitted after the payment due date.
87. Requests for additional tickets must be submitted in writing and are subject to availability. Riverside will accommodate your preferred performance times if possible but cannot guarantee availability.
88. Please check your invoice carefully as this is a confirmation of your booking date and time. Bookings are on a first-come, first-served basis.
